HOMEBUYERS HAVE CHOICES

LISTING AGENT

The listing agent is a legal representative of the seller. His job is to market the seller's house to as many potential buyers as possible. The seller expects him to sell the house for the highest possible price and on the best possible (to the seller) terms. Part of the listing agents job is to present the house to buyers in the best possible light, to maximize the house's assets and to minimize any defects the house may have. If you have ever looked at a house in the company of a listing agent you will recall that they pointed out all of the good things about the house but none of the bad things. This one-sided presentation by listing agents is the main reason the practice of homebuyers getting home inspections began. The Federal Housing Authority and many corporate relocation departments now require that buyers have home inspections done.


ABR BUYER'S AGENT

ABR is short for Accredited Buyer's Representative. Traditional real estate agents like to collect both sides of the commission whenever possible. So, when buyer agency began to spread in the late eighties the National Association of REALTORS established the Real Estate Buyers Agent Council. The purpose of REBAC is to train traditional agents to represent buyers in transactions where they don't already represent the seller. The problem is that when you, the buyer, start looking for houses with a ABR buyer's agent you don't know if you might wind up wanting to buy a house listed by the company your ABR buyer's agent works for. If you do then your ABR agent is required to switch around and become a "dual agent". He/she can no longer represent you as a buyer's agent because he/she now also represents the seller. The problem is that by now the ABR agent knows all about your financial situation, how much you pre-qualified for by your mortgage company, how much you are willing to pay, and when you have to be settled in your new home. And, now that he/she is representing the seller he/she cannot help you decide how much to offer for the house, what repairs to ask for, which home inspector is the best, and anything else that would benefit you over the seller.


EXCLUSIVE BUYER'S AGENT

In 1983, a Federal Trade Commission nationwide study revealed that over 72% of all homebuyers mistakenly believed they were being represented by the agent who was showing them homes. As a result, laws requiring agents to disclose exactly who they represent have been passed all over the country. When consumers became aware that most agents worked for the seller, they began demanding their own representation. In response, The Buyer's Agent, Inc. began offering exclusive buyer representation to homebuyers. A true Exclusive Buyer's Agent never takes listings from sellers so they never have to do the "dual agent switch". The represent buyers all the time, never sellers, so they never get in a situation where they have a conflict of interest.

Since they are members of the Multiple Listing Service they are able to show you all you the houses available in the market. And, since they get paid from the commission that is already built into the price of the house their services don't cost you anything extra.
